These Terms & Conditions ("Terms") govern your use of the Bead Board iOS application ("the app"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. License grant

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices that you own or control, in accordance with the Apple Media Services and App Store terms. This license is for your own use only.

2. Acceptable use

You agree not to:

copy, modify, or create derivative works of the app except as permitted by applicable law;
reverse engineer, decompile, or disassemble the app, except to the extent such restriction is prohibited by law;
rent, lease, lend, sell, redistribute, or sublicense the app;
use the app for any unlawful purpose or in any way that could damage, disable, or impair it;
remove or obscure any proprietary notices in the app.

3. Your content

The designs you create in the app are yours. The app stores your designs locally on your device; we do not host, access, or claim any ownership over them. You are responsible for backing up your own data, including through your device's standard backup features.

4. Intellectual property

The app, including its software, design, text, graphics, and the "Bead Board" name and logo, is owned by us or our licensors and is protected by intellectual property laws. Bead product names, catalog codes, and color references (including Miyuki and TOHO designations) are the property of their respective owners and are used for identification purposes only. Color values shown in the app are community approximations and may differ from physical beads. Except for the license expressly granted in these Terms, no rights are granted to you.

5. No professional advice

The app is a planning and visualization tool. Rendered colors, finishes, and previews are approximations and may not exactly match physical materials. You are responsible for verifying materials, quantities, and suitability before purchasing or beginning any project.

6. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any results obtained from it will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

7. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or materials, arising out of or related to your use of (or inability to use) the app, even if we have been advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability will not exceed the amount you paid for the app, if any.

8. Changes to the app and these Terms

We may modify, update, or discontinue the app or any of its features at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of [INSERT JURISDICTION], without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the app will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, except where applicable consumer-protection law grants you rights to bring proceedings elsewhere.

10. Apple App Store terms

If you obtained the app from the Apple App Store, these Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services and App Store terms of service.
